About the amendment

Amendment C138 is a joint rezoning and subdivision proposal lodged under Section 96a of the Planning and Environment Act 1987.

Amendment C138 proposes to rezone 3.9 hectares of Farming Zone land to the Industrial 1 Zone and apply the Design and Development Overlay – Schedule 5.

The planning permit application seeks approval for the subdivision of land to create 23 industrial lots.

A draft planning permit has been prepared and is included as part of this amendment.

Amendment C138 is a privately funded rezoning and development application.

Current Status

Council adopted Amendment C138 at its Council Meeting on 23 April 2024. The amendment was approved and gazetted by the Minister for Planning on 20 June 2024. The amendment now forms part of the Surf Coast Planning Scheme. Supporting documents to the amendment are provided below and via the State Government website.

The amendment applies to land at 25 Cressy Road, Winchelsea (Crown Allotments 1-9 on Title Plan 317193G, Section 72 Parish of Mirnee).

What is a privately funded amendment?

Privately funded amendments are initiated at the request of an applicant or land owner and generally relate to individual parcels of land, where the land owner is the main beneficiary of any future use or development.

Council is not obliged to process a privately funded amendment and therefore a proposal is only likely to progress if it is consistent with Council's policies for the area and it is likely to result in net community benefit.

All costs associated with processing a privately funded amendment are paid for by the applicant. The payment of fees does not guarantee Council support for the amendment.
